Why is our planning application delayed?Local Authorities have experienced significant increases in planning applications both during and after the pandemic. Due to rapid increases in demands for services and staff illness, it is placing the process under strain which is causing in some counties significant delays. Some local authorities are experiencing minor delays others are experiencing major delays of up to 9-12 months.

Are we entitled to a refund?ICI Architecture Studio fees and planning application fees are strictly non-refundable in accordance with our terms of service. Local Authorities can refund planning application fees if they exceed over 26 weeks for a decision notice to be produced. This is assessed on an individual basis.

Which Local Authorities are experiencing significant delays?Some local authorities have managed to weather the storm much better than others. The ones that we are aware of significant delays include: - Cheshire East Council - Stafford Borough Council - SMDC - Newcastle under Lyme Council - Wirral Council Minor Delays (2-3 week delays) - Birmingham City Council - Worcestershire and Bromsgrove Council

The cost of materials is rising is their anything that we can do?Unfortunately Not - Material costs are dictated by the free markets and external factors including inflationary pressures and levels of supply and demand. Whilst we can't predict the future we would hope that prices were starting to stabilise or come down soon.

How long can local authorities extend planning applications?Planning applications can be extended by up to 26 weeks to reach a decision. Whilst most aim for the 8-12 week target.

The local authority have asked for an extension of time - Do I have to agree to it?Local authorities may ask for an extension of time to determine your planning application. Whilst you do not have to accept to agree to an extension of time it may result in you receiving a planning refusal notice. Your next steps would then be to either review options and the feedback and resubmit back to the local authority or appeal through the planning inspectorates.

What is a planning inspectorate?A planning inspectorate is an organisation independent of the local authority. They are there to help with planning appeals and to assess that the planning application has been treated fairly and in accordance with the rules and regulations. You are eligible to appeal your application once through the planning inspectorates. The cost of submitting an appeal to the planning inspectorates is free of charge except for agency and consultancy fees.

I would like to withdraw our project or make alterations to our project?Withdrawing your project: You can withdraw your project free of charge and resubmit at a later date within 12 months of the original decision date. After this time period, you will be charged a new application fee. Making alterations to your project: You can still make minor adjustments and alterations to your project whilst it is still live.

What is a Prior Notification Application?A prior notification application is similar to certificate of lawful consent. The main difference with this application is that it is determined based on the opinions of your neighbours and the public. If any objection is received the application is automatically refused without exception. There is a limited set of eligibility criteria for submitting prior notification applications and therefore are not suitable for all projects. The determination period for these types of applications is 3-4 weeks as opposed to 8-12 weeks + with the traditional planning process.
